She was from Canada.

Like many bargain hunters this past weekend, Robin Crowley of Cambridge, Ontario, Canada, thought she found a deal on a new iPad Air. Robin told CTV, “I actually researched in the flyers for Black Friday deals and Target as far as I was concerned had the best deal.†Buying what was sold as a brand new iPad, the shopper was surprised when she opened up the sealed box and turned on the gadget.

Just a tip for all those Apple users out there, Apple is big refurbisher on their computers and devices. When people return or old demo devices get returned, they all go back to Apple. The devices get tested, faulty components get repaired, supposedly restored/wiped, re-tested, and sent back to the stores. But sometimes old data can be found on them.

In my line of work, my work has found on iPhones or Mac hard drive artifacts to contain 2-3 user accounts worth of info on them. So don't think your new iPhone or MacBook is new. It may have a lot of refurbished components.

I'm no legal expert, but, I'm sure "refurbishing" devices, and selling them as "New" violates some sort of Consumer Protection Laws..
 
I remember the dust-up after a guy bought a digital camera & discovered previous owner had soft porn shots of his girlfriend.
 
On the one hand I'd say "Why Would You Send Some Back With Your Personal Information On It?"
On the other shame on Apple for not making sure it wasn't wiped clean before sending it out again.

I think they have some kind of wording buried deep in their contracts about how the components will all be brand new but the case might not or some such thing.
It's sneaky but legal.
 
I've exchanged my iPhone for a new one at the Apple Store and the employee had me go through the menu myself to wipe the old phone's existing data.

Long time visitor but first time poster. I work at one of the Canadian stores and something was posted on The Source about iPads. It said that under no circumstances can 'display iPads' be sold and that over the past few weeks a few display devices were sold. It said that many apps are preloaded and there are certain functions on it that make the iPad seem used when in reality these functions are installed to give the guest the chance to see how it works and that Target wouldn't sell it used. So just an FYI that it could have been possible the iPad was new but a display model.
