My daughter has worked as a part time employee for 7 months. Shortly after she was hired, she found out she was pregnant. She has 2 weeks til her due date and Her leave was denied. She is afraid that she will lose her job because she CAN'T work. They can't fire her for going on maternity, can they?
 
No. Please ask her to contact etl-hr, without delay. There is a form called an leave of absence, they need to fill out. On the denied off request, it sounds like it was done on spot hr portal.

Leave of Absence Policies
A leave of absence may be granted if you need time away from work due to illness, personal emergency or other compelling personal matter. If one of these circumstances requires you to be away from work for an extended amount of time, you must be placed on leave of absence.

Overview
During your leave, your employment status will not change and you will retain eligibility for benefits (if applicable) for up to 180 days.

A number of factors will be taken into consideration when approving the leave including:

  • Your eligibility as outlined in the Target guidelines
  • The leave type requested
  • The reason for the request
  • The effect the leave will have on work requirements and staffing in your department

Please work with your HR team or leader to determine if you are eligible for a leave and the type of leave that best fits your needs.

Leave status begins when you are away from work on the:

  • Third scheduled day for distribution and headquarters nonexempt team members
  • Eighth calendar day for distribution and headquarters exempt team members and all store team members

Note: These are guidelines only. Depending on the reason for the leave, it may begin on the first day you miss work.

You should contact the Target Leave and Disability team at the beginning of your leave if it is anticipated that it will be longer than three days for distribution and headquarters nonexempt team members or eight days for all other team members.

School is up to 1 year.
 
She isn't covered under FMLA.

I'm not certain how many hours we have to work to be eligible for medical LOA. Has she spoken with her etl-hr?

She should be covered under FMLA for 12 weeks of unpaid leave if needed.

If she just put in a LOA , then they can do that.

Your friend has to have worked over 1,250 hrs. over the past year. Meaning she has to have averaged over 24 hrs./week.
I ran into this roadblock earlier this year.
She needs to call the outside company that handles this for Target, sorry, forgot their name. She can get the number from HR. Probably is available from eHR too.

Short term disability is handle by Hewitt.
 
You are eligible for FMLA if you have worked for Target for at least 12 months and have worked 1250 hours in the past 12 months.

So your daughter is not eligible for FMLA. Even if she had worked there for 12 months, they require 30 days notice unless there is an emergency.

With this being said, Target's medical leave of absence may be different than FMLA. For example, in California, one is eligible for pregnancy leave on the hire date. So she needs to contact the Target Leave and Disability Team for state specific information. Get the number from HR.
 
Also many states have laws against discrimination in the case of pregnancy which this clearly would fall under.
Have her check state laws.

Starting in JAN. You get two weeks unpaid if you're part time and two weeks paid if you're full time .
