Archived New AP video hits the web-- should this shoplifter be charged with murder??

At walmart they are not allowed to do what they did in the video. AP can approach them and allow them turn themselves in, but if they refuse we must let them go. Its all for safety. Working over nights I can't tell you how many times in the last 9 months I've been with the compney that we had **** stolen from us. (just over nights) TVs, Beer you name it.

Sad to hear about the AP at target. The guy needs to be held accountable for what he done.
 
In some states you can be charged with murder if you are committing a felony that causes someones death.... even if you didn't take any other action to kill them yourself. The legal term for this is "felony murder". However, the theft in his state would have to be a felony (maybe it is for the dollar amount, but unlikely) - plus his state will have to have "felony murder" as an actual crime. Technically this guy would probably have to have committed robbery to be charged with felony murder, but it looks like he only committed theft.

This is - IMO - why working AP is incredibly stupid. I would never take an AP job. Your life is not worth $8.50/hour.

Should a 65 year old man be in a position that does require such physical exertion? Yeah the guy was shoplifting and resisting but he shouldn't be charged with murder. He never even physically touches the tps. He should do jail time for shoplifting and possibly face involuntary manslaughter charges, but not murder.

Before I worked at Target, I worked at Lowes as a cashier. Our store was robbed blind all the time. People would simply walk past the checklanes, and walk right out the door with cart loads of stuff. Most of the time the alarm would trip, but all were allowed to do is ask for there receipt. If they refuse or keep on walking, were supposed to reset the alarm and get back to work. If the alarm doesn't trip were not allowed to say anything at all :huh:.

I remember ringing up some very expensive things payed with those merchandise credit gift cards....

oh I'm sure many things happen during the day. Months ago we had someone walk in the back, grab a TV and went out the fire exit where there was a car waiting for them. LAst week we had someone try to return $100 worth or rogane and cash in an other stores giftcard.

The beer runs usully happen after 2am, the time when we have to stop selling beer.
 
At the Walmart where I work, someone stole a forklift.
They take TVs out through the fire exit in sporting goods, through the exit in the grocery backroom, through garden center, etc.
One of my coworkers even saw a guy stuff his backpack with electronics merchandise. We actually got the stuff back because he was dumb enough to put it down long enough for my manager to get it.
They really do steal anything and everything. Nothing surprises me anymore.
At least our managers are allowed to kick people out. The overnight manager starts their shift at 8 p.m. and Saturday night of Memorial Day weekend, my manager told us at the meeting that she had already kicked out three people since the start of her shift.
Never mind the nightly overhead pages of "maintenance to the alcohol aisle for a spill cleanup."

At lowes, the people could have cared less about the time of day or the alarms. Some very shady contractors at our store were taking cooper fittings and returning them to pay for all of there supplies. The alarms are pretty much useless, all the strobe lights and loud voices saying to stop didn't matter to the people. Because in the end, the employees can't do anything about it besides annoy the he** out of them with customer service.

Thoughts and prayers go out to the family of the TPS tea member. I am foreseeing mandatory annual physicals and stricter health requirements for all Asset Protection personnel. Truly a sad story.

That is considered grand theft (felony). Anything over $300.

and my boss has kicked a number of people out as well. Kids riding in the electric carts. Woman who want to cut open all the watermelons to see if they are ripe enough.

We had a guy who sprayed painted some BBQs and another custmorer took his paint away. Well the guy was dumb enough to run in the store and try to pry open the paint case and when the asst. manager stoped him and told him he needed to leave the guy head butted him and tore apart action ally. Lets just say it was a mess and enough for about six cops to come and pay us a visit.

First of all I send my sympathy and prayers to the TPS's family, very sad. Second while I believe that he needs to be charged with something, I don't think it should be murder.
 
maybe manslaughter at most...but if i was on the jury, they'd have to prove beyond a reasonable doubt that the man infact did die from the altercation...does heart disease run in his family? What age did his descendants die and from what? Did he eat McDonalds alot? Charge them with murder too? Was he a marlboro man??? More charges!

The approach for the undercover was unprofessional. He should have at least given the shoplifter a chance to comply and be escorted back before he comes out and bear hugs him lollll ...or just partnered with law enforcement and had the cops waiting outside...

But sad story for the TPS. That's unfortunate.

That sucks.

One of the things that a lack of sales floor causes is social mores or "norms" to begin to fall apart. As there is less and less authority out there to handle the situations, guests become freer and freer to act out against the latest employees.

This is the flipside to the Broken Window Theory, that constantly repairing the window without dealing with the bad neighborhood or showing any force results in the window being broken every time it is fixed.
