They can certainly shut the store down for remodeling but you have to bet the union is betting on that tactic.
The federal government might not back the workers but the state of New York is very worker friendly especially when it comes to union protections.
I'm willing to bet the union already has their lawyers writing the hold order against Spot before the vote even happens.
There are certain orders judges can issue in labor disputes that keep employers from doing any major changes in the business structure until such time as it is proven that the changes are not in response to the labor action.
