Does anyone know which states still have Sunday premium pay for retail? To be more specific I might be moving to MA and since they have blue laws I was wondering about it and if you work in a Sunday premium state does it mean you can work 40 + Sunday without hitting OT?

But to answer your question, if you are already paid time-and-a-half it does not count toward your 40 hours. They may limit you to save money, but you would hit OT until you've worked 40 + Sunday.

I work for spot in MA in flow team and premium pay makes all the difference. Since lot of stores forbid OT, and BTC in MA is almost as big a deal as Black Friday (at my location at least) its likely that flow team and o/n backroom works six days. Premium doesnt count towards overtime if your already working 40 or even 48 hours. Assuming you work 40 a week, your check will look like:

Regular: 64 hours
ShPrem: 16 hours

And if your sheduled 48 hours a week during high sales periods:

Regular: 80 Hours
ShPrem: 16 hours

So you'll get overtime pay every Sunday without being in overtime.
