I was watching a video of a man complaining to an employee about the restroom policy. He than asked her for her name and kept babbling on. Management had to get involved and kick the guy out.

If the employee asked him to stop filming her would he have to put it up? I was just wondering cause if that was me that would have been the first thing I would told him.

Technically the store can tell him to stop filming in the store, period.
It's private property and he can be asked to leave if he doesn't stop.

Yeah, I'd ask them to stop.
It's rude and off putting.
As a state employee we get people who think that they have the right to film us because 'we work for them'.
Bullshit, shut off the camera or leave.
I don't give you permission and I have rights too.
I'm not a cop or a National Guardsman beating up some protestor, back the hell off.

in the store there is no reasonable expectation of privacy. The customers can film.

If I remember in some states that it is illegal to get voice recording, that includes video with audio, of someone without their permission. Penalties if you do not can be quite large lawsuit wise.
Yup which is why companies sell security cameras that as a feature do not have audio to comply with wire-tapping laws in those states.

Wonder if you rko him while filming if JR would do commentary for when it goes viral.

GOD AS MY WITNESS, HE IS BROKEN IN HALF!

Also, I'd completely disregard the restroom question.
"Are you finding everything alright?"
"Have you heard about all the benefits of signing up for a Target RedCard?"
"Alright, have a nice day sir."

They wanna play games? I'm great at games.

Basically, this. Just steam roll their antics with great guest service.

The policy at the Targets I worked was no cameras, ever. We were instructed to ask the guest to stop filming or taking pictures. If they didn't comply, AP was called and the guest was escorted out. The only exception was vendors taking pics of their end caps.

if i remember penalties are for criminal cases while lawsuits are civil and have damages. and you have to prove damages to win a lawsuit. someone filming you in target working and putting it up on youtube won't cause you damages on it's own.

I've had a fear of being filmed before this stuff started occurring. I've pictured scenarios about "what if some scammy/exploitive guest came and filmed me because I won't do their return." If it ever happens, I plan on just walking away immediately, as fast as I can into an area the person can't follow me, and then calling the LOD or AP for help. Regardless of wether it's allowed or not, you don't have to deal with that shit.

Laws regarding filming can vary by state, but I'm pretty sure Spot has a corporate policy of no filming.

If there is a policy about it, they sure don't enforce it when the hip2save blogger is in the store. She films a video there every week highlighting all the deals for that week. There is no way an employee hasn't heard her when she's dancing around the store or out front on one of the big red balls!

God she hasn't fallen off the face of blogdom yet?

With the recording laws a civil lawsuit can happen even without visible damages. In the case of videotaping your work, and being asked questions, Any damage could be in the form of a single nasty comment on Facebook/YouTube. Then damages are then emotional damages.

I noticed (while re-watching it) that there were other men also recording the employees.
