Do the hours worked on Jan 1 count towards a 40 hour week? It is my understanding that holiday hours paid at time and a half are not included in the total for the week, therefore, one could work up to 40 hours, not including the holiday, and not go into overtime pay.
Is this correct?
 
It may depend on your state.

Where I am from, you count your hours like usual for the week. Whatever hours you work on New Years is still that many hours. But you get paid Time and a Half. If you work over 40 hours for the week, you get overtime pay as well.

The only time Overtime gets delayed is if you work a week with paid leave

If you're in California that is correct, however, it varies by state. So you could essentially work 48 hours that week.
 
Where I live it is 40 regularly paid hours that are needed before OT becomes mandatory.

I work 45 hours this week.

8 of those were New Years.

I am only getting time and a half for 8 hours, not 13 hours.

That's how it is in my state too. I hate it, it's such a ripoff. I refuse to work OT on weeks with holiday pay.
